Shipping Policy

 

 

ARS Foundation may arrange or coordinate the shipment of artworks, publications and related cultural materials in the context of its artistic, educational and institutional activities.

 

 

 

1. Scope of Application

 

 

This Shipping Policy applies to the shipment of physical items facilitated by ARS Foundation, including but not limited to artworks, exhibition materials, catalogues and publications.

 

 

 

2. Shipping Arrangements

 

 

  • Shipments are organized on a case-by-case basis and may be handled through professional fine art logistics providers.

  • Shipping terms, costs, insurance coverage and delivery timelines are specified individually and confirmed in writing prior to shipment.

  • Unless expressly agreed otherwise, shipping costs, insurance, customs duties, taxes and import fees are borne by the recipient.

 

 

 

 

3. Packaging and Handling

 

 

  • Artworks are packaged in accordance with professional art handling standards appropriate to the nature and value of the items.

  • ARS Foundation may rely on specialized third-party providers for packing, transport and customs clearance.

 

 

 

 

4. Delivery Times

 

 

  • Estimated delivery times are indicative only and may vary depending on destination, customs procedures, carrier availability and external factors beyond ARS Foundation’s control.

  • Delays caused by carriers, customs authorities or force majeure do not constitute grounds for liability or compensation.

 

 

 

 

5. Transfer of Risk

 

 

  • Unless otherwise agreed in writing, the risk of loss or damage transfers to the recipient upon handover of the shipment to the carrier.

  • Where insurance is arranged, coverage will be limited to the terms and conditions of the insurer.

 

 

 

 

6. Recipient Responsibilities

 

 

The recipient is responsible for:

 

  • Providing accurate and complete shipping and contact information;

  • Ensuring availability to receive the shipment;

  • Complying with import, customs and local regulatory requirements.

 

 

ARS Foundation is not responsible for delays, losses or additional costs resulting from incorrect or incomplete information provided by the recipient.

 

 

 

7. Damaged or Lost Shipments

 

 

  • Any visible damage must be reported to the carrier immediately upon delivery and documented in writing.

  • Claims related to loss or damage must be notified to ARS Foundation within seven (7) days of receipt.

  • ARS Foundation will assist, where appropriate, in coordinating claims with the carrier or insurer but does not assume liability beyond the agreed shipping terms.

 

 

 

 

8. Force Majeure

 

 

ARS Foundation shall not be liable for failure or delay in shipment resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, transportation disruptions, governmental actions or customs restrictions.

 

 

 

9. Governing Law

 

 

This Shipping Policy shall be governed by Swiss law, in particular the Swiss Code of Obligations.
