This Refund Policy applies to payments made to ARS Foundation through its website or digital platforms, including online donations, contributions and program-related payments processed via Stripe or other authorized payment providers.
By completing a payment, you acknowledge and agree to this Refund Policy.
2. Donations and Voluntary Contributions
ARS Foundation operates as a cultural and non-profit institution.

All donations and voluntary contributions are final and non-refundable.

Donations are considered irrevocable once the payment is successfully processed.

Refunds will only be issued if required by mandatory provisions of Swiss law or in the event of a demonstrable technical error (e.g. duplicate charge).
Donors are encouraged to review their contribution carefully before confirming payment.
3. Program Fees and Participation Payments
Where applicable:

Fees paid for participation in programs, exhibitions, residencies, advisory services or other foundation activities are non-refundable, unless expressly agreed otherwise in writing prior to payment.

Initial, administrative or preparatory fees cover curatorial, organizational and strategic work and are therefore not subject to reimbursement.
Any specific refund conditions agreed contractually shall prevail over this general policy.
4. Payment Processing via Stripe
Payments made through Stripe are subject to Stripe’s own terms and conditions.

ARS Foundation does not store full payment card details.

All payment data is processed securely by Stripe in accordance with applicable security standards.

In the event of a payment dispute or chargeback, ARS Foundation reserves the right to provide relevant transaction information to Stripe or the payment card network.
5. Chargebacks and Disputes

Donors and users are encouraged to contact ARS Foundation directly before initiating a chargeback or dispute through their bank or payment provider.

Unauthorized or unjustified chargebacks may result in suspension of access to foundation programs or future participation opportunities.

ARS Foundation reserves the right to contest chargebacks that are inconsistent with this Refund Policy.
6. Errors and Exceptional Circumstances
Refunds may be considered only in exceptional cases, such as:

Duplicate payments made in error;

Technical processing errors attributable to the payment system.
Any refund granted will be processed using the original payment method where possible.
7. Processing Time
Where a refund is approved, it will be processed within a reasonable timeframe. The time required for funds to appear in the donor’s account depends on the payment provider and the donor’s bank.
8. Legal Compliance
Nothing in this Refund Policy limits or excludes rights that may not be waived under applicable Swiss law.
9. Governing Law
This Refund Policy is governed by Swiss law, in particular the Swiss Code of Obligations.
